Description: A NOTARIAL GUIDE AND BOOK OF FORMS FOR THE USE OF NOTARIES, CLERKS OF COURT AND LAWYERS PREPARED BY H. H. WHITE, Of the Alexandria Bar FOURTH EDITION. Published By F. F. HANSELL & BRO., Ltd. NEW ORLEANS INTRODUCTION TO FIRST EDITION. The office of notary public, under our law, is one of honor, trust and responsibility. In the language of the Supreme Court in the case of Bou-chereau vs. Jones, 29 An., p. 86: "High and important functions are intrusted to notaries. They are invested with grave and ex- tensive duties; they are charged with the solemn preparation of the authentic evidence of our transactions, of last wills, of those titles which pass from one generation to another. Their responsibility is as high as their trust, and a notary who officially certifies as true what he knows to be false violates his duty, commits a crime, forfeits his bond, binds himself and binds his surety." Such being the gravity of his responsibility, to what authority shall the notary turn in order to thoroughly prepare for his duty and for a guide when he is in difficulty or doubt as to the proper course to pursue in any given case? He will find the law that governs his duties scattered through the various sections of the "Revised Statutes," the "Code of Prac-tice," the "Civil Code," and in the acts of the Legislature, the decisions of the Supreme Court, and the common law and the law merchant. The author is aware of no work which presents clearly and succinctly the notarial law of Louisiana, and it is with a view to supplying a decided and felt deficiency that this book is written. The purpose is to provide in one convenient book, at reasonable cost, all the code and statute law relative to notaries and their duties, with such decisions of the Supreme Court as are necessary to their proper understanding, and to give such comment and authority as may be necessary to explain the duties that arise from the common law and law merchant. This will be supplemented by a set of forms, an attempt being made to give a sample of each kind of act or writing incident to the notarial profession or in common use in Louisiana.
